How do promotional disclaimers vary by region?

If you send email to people in different countries, the footer that works in the US won't cut it in Germany or Canada. Every region has its own rules about what has to appear in a commercial email, and some are stricter than others.

Here's a quick breakdown of the major regions and what they actually require:

United States (CAN-SPAM)
Promotional emails must be clearly identifiable as advertisements. You need a physical mailing address and a working opt-out mechanism. The FTC also requires clear disclosure of material connections. If your email contains affiliate links or sponsored content, say so. There's no mandated exact wording, just clear and conspicuous placement.

Germany (Impressum)
This one goes further than most. German law requires an Impressum in any commercial communication, including email. That means your company name, physical address, registration number, VAT ID, and the name of a responsible person with contact details. If you have German subscribers, this belongs in your footer every single time.

Canada (CASL)
Canada's anti-spam law requires you to clearly identify who is sending the email, provide contact information, and include an unsubscribe mechanism with specific wording. CASL also has strict consent requirements before you can send at all, which is worth understanding separately.

EU (GDPR)
GDPR focuses more on why you're allowed to send than on what your footer says. You need a lawful basis for processing the recipient's data. Depending on that basis (consent, legitimate interest, contract), your disclosure obligations shift. If you're relying on consent, that consent needs to be documented and easy to withdraw.

A practical tip: if you send internationally and don't want to maintain separate templates for each region, build your footer around the strictest standard. Germany's Impressum requirement, combined with a clear unsubscribe link and your physical address, covers most of what other regions need too. It's not perfect for every edge case, but it's a reasonable baseline for small senders.

And if your list spans multiple countries and you're unsure whether your current footer meets local rules, it's worth a quick audit. You can also check whether your unsubscribe mechanism is set up correctly, since that's required almost everywhere.
